Terms of Use

These Terms of Use govern your access to and use of Lohaty Studio (the Service). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Description of the Service

Lohaty Studio is an online studio for creating, customizing, and purchasing wall art and related products. You can upload your own images, generate images using AI, preview crops and frames, add personalized message cards, purchase gift cards or AI credits, check out as a guest or with an account, and track orders. We also host a curated marketplace of designs contributed by artists. Physical items are produced on demand and shipped to supported destinations (including domestic, GCC, and select international locations).

Account Registration & Eligibility

You must be legally capable of entering into a binding contract and at least 13 years old (or the minimum age in your jurisdiction) to use the Service. You agree to provide accurate information, keep your credentials secure, and promptly update information so it remains accurate. You are responsible for all activity under your account.

Authentication & Security

Passwords are hashed using industry-standard algorithms and never stored in plain text. We may verify phone numbers via one-time codes delivered through messaging channels. You are responsible for maintaining the confidentiality of your credentials and restricting access to your devices. Notify us immediately if you suspect unauthorized use.

Acceptable Use Policy

You agree not to misuse the Service. Prohibited activities include: violating laws or third-party rights; creating, uploading, or generating unlawful, hateful, harassing, violent, sexually explicit, or exploitative content; bypassing security or rate limits; scraping without permission; interfering with or degrading the Service; reverse engineering; sending spam; or using the Service to train models or build competing datasets without our written consent.

User Content & License

You retain ownership of content you upload or submit, including images, prompts, messages, and designs (User Content). You grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, reproduce, modify, adapt, print, transmit, display, and distribute User Content as necessary to operate, improve, market, and provide the Service (including order fulfillment, previews, and customer support). This license survives for a commercially reasonable period to complete ongoing services, maintain backups, comply with law, and resolve disputes.

You represent and warrant that you own or have all rights necessary for the User Content you submit, and that our use will not infringe or violate any third-party rights or laws.

AI-Generated Content

When you request AI-generated images, your prompts and any reference images may be transmitted to AI service providers to generate outputs. We may apply safety filters and rate limits. AI outputs can be unpredictable or contain artifacts; you are responsible for reviewing outputs before ordering or sharing.

Subject to applicable law and model policies, you may use AI outputs for personal and commercial purposes. You acknowledge that AI outputs may be similar to content generated for others. You must not use the AI features to generate unlawful, harmful, defamatory, or infringing content.

Intellectual Property

All site content (excluding User Content) including text, graphics, logos, icons, images, software, and trademarks are owned by us or our licensors and are protected by applicable laws. Except as permitted by these Terms, you may not copy, modify, distribute, or create derivative works of our content without written permission.

We respect intellectual property rights. If you believe content on the Service infringes your rights, contact us with sufficient details to identify the work and the allegedly infringing material so we can investigate and respond, including by removing content where appropriate.

Marketplace & Contributor Terms

If you participate as an artist/contributor, you grant us a non-exclusive, worldwide license to reproduce, display, market, and sell prints or digital derivatives of your submitted designs through the Service.

You warrant that you own or control all rights necessary for designs you submit and that your designs do not infringe third-party rights. We may remove designs at any time (for example, due to legal risk or policy violations). You are responsible for taxes arising from royalty payments. We may offset or withhold payments as required by law or to address fraud, chargebacks, or errors.

Order Process & Production

Most products are made to order. Once an order enters production, changes or cancellations may not be possible. Visual previews (including cropping and frame simulations) are very close approximations. Actual colors, materials, and finishes may vary due to device screens, lighting, and manufacturing tolerances.

Shipping & Delivery

Shipping options and lead times are shown at checkout and depend on destination and item size. Typical delivery windows after production are: domestic 2–4 business days, GCC 3–6 business days, and select international destinations 5–10 business days. These are estimates only and not guarantees.

You are responsible for providing a complete and accurate shipping address. Risk of loss passes upon delivery to the address provided. For international shipments, you are responsible for any customs duties, taxes, import fees, or clearance/handling charges assessed by authorities or carriers. These charges are not included in the item price or shipping cost and may be collected on delivery unless stated otherwise.

Returns, Replacements & Refunds

We stand behind the quality of our products. If your order arrives damaged, defective, or incorrect, contact help@lohaty.studio within 14 days of delivery with your order number, photos of the issue, and a brief description. After inspection, we will, at our discretion, reprint/replace the item or provide a refund.

Because most items are customized and made to order, returns for change of mind, preference, or user-submitted content issues are generally not accepted. Digital items (including AI credits) are non-refundable except where required by law.

Gift Cards & Credits

Gift cards and credits are redeemable only through the Service, are not redeemable for cash (except where required by law), and cannot be replaced if lost, stolen, or used without permission. Expiration and other terms may apply as shown at purchase or in your account.

Pricing, Taxes & Currency

Prices, fees, and taxes are shown at checkout and may vary based on destination, currency, or applicable laws (e.g., VAT). We may correct pricing errors at any time. If a pricing or discount error is discovered after your order, we may cancel and refund, or contact you to confirm the corrected amount.

Payments

Payments are processed by one or more independent payment service providers. We do not store full payment card numbers on our servers. By submitting a payment method, you authorize us (and our payment processors) to charge your method for the order total, including applicable taxes, fees, and shipping.

Orders may be delayed or canceled for fraud prevention, non-payment, chargebacks, errors, or policy violations.

Promotions & Discounts

Promotions, discounts, and credit offers are subject to their specific terms, are non-transferable, and may not be combined unless expressly permitted. We may revoke or cancel discounts if we suspect abuse or error.

Third-Party Services

We rely on third-party providers for hosting, storage, payments, messaging, analytics, shipping, and other operational needs. Their terms and privacy practices may apply. We do not control and are not responsible for their services.

We collect information you provide (e.g., account, orders, uploads, prompts), information generated during your use (e.g., logs, device info), and information from third parties (e.g., payment confirmations). We use this data to provide and improve the Service, process orders and payments, secure accounts, communicate with you, and comply with law.

Information We Collect

Account and profile data (name, email, phone, language), addresses, order details, uploaded images and message card text, prompts and AI preferences, communications with us, device and usage data (including IP address, browser, OS, timestamps, and referral), and cookies or similar identifiers. For payments, our providers receive the necessary payment information and may return non-sensitive tokens or confirmations to us.

How We Use Information

To provide, secure, and improve the Service; authenticate users; send verification codes; process and fulfill orders; generate and store images; provide customer support; personalize experiences; conduct analytics; prevent fraud and abuse; comply with laws; and, where permitted, send marketing and service communications. You can opt out of non-essential marketing communications at any time.

Legal Bases for Processing

Where required (e.g., in the EEA/UK), we process personal data based on: performance of a contract (providing the Service and fulfilling orders), our legitimate interests (security, improvement, fraud prevention, analytics), your consent (where applicable, e.g., certain cookies/marketing), and legal obligations.

Data Retention

We retain personal data for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods vary by data type and context (e.g., order records, invoices, and audit logs may be retained for statutory periods). Backups are maintained for continuity and security.

We may process and store information in countries other than your own. Where required, we implement appropriate safeguards for cross-border transfers (such as contractual protections), while ensuring your information receives an adequate level of protection.

Your Rights

Subject to applicable law, you may have rights to access, correct, delete, restrict, or object to processing of your personal data, and to data portability. We use essential cookies to operate the Service, and (where permitted) functional, analytics, and advertising cookies to improve performance and personalize content. We implement administrative, technical, and physical safeguards designed to protect information, including encryption in transit and access controls. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

Children

The Service is not directed to children under 13 (or the relevant minimum age in your jurisdiction). If we learn we have collected personal data from a child contrary to law, we will take appropriate steps to delete it.

Suspension & Termination

We may suspend or terminate access to the Service (including orders) for violations of these Terms, suspected fraud, abuse, or security risks. Upon termination, certain provisions survive (including ownership, licenses granted to us for ongoing services, disclaimers, and limitations of liability).

Warranty Disclaimer

The Service and all products are provided on an 'as is' and 'as available' basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. To the fullest extent permitted by law, we disclaim all warranties arising from course of dealing or usage of trade.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability for any claim relating to the Service shall not exceed the amounts you paid to us for the order or Service giving rise to the claim during the one (1) month preceding the event.

Indemnification

You agree to defend, indemnify, and hold harmless Lohaty Studio and its affiliates, officers, employees, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to your use of the Service, your User Content, your orders, or your violation of these Terms or applicable law.

Force Majeure

We are not responsible for any delay or failure to perform due to causes beyond our reasonable control, natural disasters, epidemics, war, terrorism, civil disturbances, labor disputes, power or internet failures, or actions by governments or third parties.

Modifications to the Service & Terms

We may add, remove, or modify features and these Terms at any time. Material changes will be communicated where required. Changes are effective when posted unless stated otherwise. Your continued use after changes become effective constitutes acceptance.

Third-Party Services

We may integrate or link to third-party services or carriers. Your use of third-party services may be subject to separate terms. We are not responsible for third-party services and do not endorse them.

Governing Law & Disputes

These Terms are governed by the laws applicable in the United Arab Emirates to the extent not overridden by mandatory consumer protection or data protection laws of your habitual residence.

Age Restrictions

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Lohaty Studio.
